Lesson T & Cs

I, David Prodger, am the proprietor and representative of Drive Fareham driving school.

By taking driving lessons with Drive Fareham, it is accepted that you have read and agree to these terms and conditions.

You will be fit to drive:

• Not under the influence of any substance that may affect your ability to drive, including (but not limited to): alcohol, prescription drugs (that may affect your ability to drive), illegal drugs or any other substance that may affect your ability to drive. You will inform your instructor in advance of any medical or other condition which could affect your ability to drive.

• You will wear suitable clothing to allow you to operate the controls of the vehicle, particularly footwear and any required contact lenses or glasses.

• You will bring your current and valid driving licence with you and inform your instructor in advance of any change to it due to medical condition, driving conviction or any other cause.

If, in the professional opinion of Drive Fareham, it is thought that you are unfit to drive for failing to meet any of these conditions, the lesson will be cancelled at your expense.

Drive Fareham cannot accept responsibility for any injury, loss or damage arising from a driving lesson.

Lesson payments must be made at the beginning of each lesson by cash, or in advance of the lesson by bank transfer. Block bookings must be paid for in full on the first lesson of that block. Refunds will only be made in exceptional circumstances at the discretion of Drive Fareham. If you suspend taking any pre-paid tuition for a period of 12 weeks or more, any remaining tuition owed will be forfeited.

Price Guarantee: Drive Fareham will not increase your lesson price once you start taking lessons, subject to our fair use policy, namely: you must continue to take a minimum of three, 2-hour lessons per month and you must pass your test within 12 months.

Cancellation: 48 hours (2 days) notice is required to cancel any driving lesson. If less than 48 hours (2 days) notice is given, the full lesson fee must be paid.  The same condition applies for any agreed lessons not attended by the pupil. In such a circumstance Drive Fareham will wait for a period of 10 minutes after the start time of the lesson before departing if no contact from the pupil is made.

Drive Fareham cannot be held responsible for any mechanical or electrical failure which may cause the prevention or termination of a lesson or driving test. If the weather is too severe to safely drive, Drive Fareham will re-arrange your lesson with you. The decision will be made by Drive Fareham considering your ability and any advice given by motoring organisations. If you decide to cancel due to weather and the conditions are suitable to drive, the lesson will be chargeable.

Lessons:

• The driving lesson will be on a one to one basis. If you would like a parent or friend to come along on your lesson, please request this at least 24 hours in advance of the lesson. This remains at the discretion of Drive Fareham.

• You will always receive the full lesson time you have paid for.

• Lessons can begin and end at different locations (e.g. home, work, college), subject to prior arrangement at least 1 week in advance and the pickup/drop-off being within Drive Fareham’s working area. This remains at the discretion of Drive Fareham.

Penalties: Whenever you are driving in Drive Fareham’s vehicle, you will be under close supervision. However, Drive Fareham cannot be held responsible for any infringement of the law. Any fines that are incurred will be the responsibility of the driver.

Practical tests:

• Drive Fareham will provide professional guidance on when is an appropriate time to take your test in line with your progress.

• In the interest of road safety Drive Fareham reserve the right to withdraw the use of their car for tests without prior notice, should you prove to be unsafe and not up to test standard.

• Any test booking should be agreed with Drive Fareham at the time of booking to ensure that your instructor and Drive Fareham’s car are available at that time.

Damage: During lessons, Drive Fareham will make every effort to avoid damage to all vehicles and property. However, if Drive Fareham consider that you were driving in a dangerous or unpredictable way during a lesson and contrary to Drive Fareham’s guidance and material damage occurs, you will be expected to pay towards repairs (up to the level of excess on the instructor’s insurance policy). This will be discussed at the time of the damage. In addition, during driving tests, the examiner will not prevent you, the candidate from hitting the kerb or causing other similar minor damage to the car. Therefore, all damage caused by you whilst on test will be charged to you (up to the level of excess on the instructor’s insurance policy).

Punctuality: Drive Fareham will contact you if we are going to be later than 5 minutes for your driving lesson. The time lost will be added to the end of the lesson if possible, or added to another lesson at a later date. If you are late for your lesson, then that time will be lost.

Communications: To ensure that communication channels are in place, please ensure that I am aware of your current mobile phone number.

Holidays and Availability: I will give you notice of holidays or days where I am unavailable. Please ensure that you do likewise. Please be sure to book your first lesson after your holiday or break in tuition, to retain your place on the diary and to maintain progress.

Code of Practice: I will abide by the Voluntary Code of Practice which has been agreed between DVSA and the main bodies representing Approved Driving Instructors.

Your Data: Drive Fareham will process and store your data relating to your personal contact details, driving licence information, training progress and any other information relating to your driver training both during your training and afterwards in accordance with the relevant data protection law.

Complaints: Complaints by clients should be made in the first instance to Drive Fareham. Failing agreement or settlement of a dispute, reference may be made to DVSA’s Registrar of Approved Driving Instructors who will consider the matter and advise accordingly. Should the Registrar not be able to settle the dispute he or she may set up a panel, with representatives from the ADI industry, to consider the matter further or advise that the matter should be referred to the courts or other statutory body to be determined.
